Terms and Conditions

1. General information

These Terms and Conditions (hereinafter, the "Conditions") govern the contracting of the training services offered through the website https://trading.net (hereinafter, "the Website") by:

Hereinafter, "TRADING.NET" or "the Owner".

Contracting any of the services implies full and unreserved acceptance of these Conditions, as well as of the Legal Notice, the Privacy Policy, the Cookie Policy and the Training Service Notice.

2. Definitions

  • User / Client: a natural person, of legal age, who accesses the Website and/or contracts the services.
  • Service: access to the educational Digital Training Materials, as well as to the complementary services described in these Conditions.
  • Digital Training Materials: content in electronic format (videos, documents, recordings and other resources) which is deemed to be supplied in its entirety from the moment the User obtains access to it.
  • Reference financial instruments: for purely training purposes, the training covers instruments such as stocks, currencies (Forex) and derivative products. The training does not include crypto-assets.

3. Purpose and nature of the service

The purpose of the contract is the provision of an educational training service in the field of trading and the financial markets.

The Service is exclusively of a training and informational nature and does not constitute financial, investment, tax or legal advice, nor does it guarantee returns or economic results of any kind, as specified in the Training Service Notice, which forms an inseparable part of these Conditions.

4. Contracting and registration requirements

In order to contract, the User must be of legal age and provide truthful, accurate and up-to-date information. Registration may take place via a form or, where enabled, through social network login (for example Instagram, LinkedIn or X/Twitter), in which case the User authorizes the processing of the strictly necessary data.

The User is responsible for safeguarding their access credentials and for any activity carried out through their account.

5. Description of the programs

TRADING.NET offers the following programs:

5.1. DayTrading Program

A training program whose core content consists of Blocks I and II, which comprise a set of hours of digital lesson content covered by the price of the course.

On a complementary, free-of-charge, non-essential and non-guaranteed basis, and subject to availability, the program may include:

  • Support through messaging channels and ticket-based assistance.
  • A private channel (for example, on Telegram) with monitoring of trading activity.
  • Live sessions on business days.
  • Extra Blocks, meaning all content other than Blocks I and II (for example advanced content, Forex strategies, taxation and updates).
  • Access to complimentary funding evaluations: such access is granted after passing the relevant exam, for a value that will, at a minimum, exceed the value of the course.

The Owner may modify, replace or withdraw the complementary services without this altering the essential contracted content (Blocks I and II).

5.2. TradingMentorías Program (1-on-1 Mentoring)

A personalized support program that includes:

  • Access to a pool of mentors through the booking calendar provided.
  • A total of 12 mentoring sessions spread over 6 months, with a guarantee of two sessions per month.
  • Mentor support through messaging channels.

If the Client stops paying the monthly installments for the mentoring program, they will lose access to the contents, without this releasing them from the obligation to continue paying the remaining installments in accordance with the contracted payment plan.

6. Prices, payment and financing

6.1. Price

The base price of the program is €2,400. The final price applicable in each case may vary depending on the commercial offer in force, and on any promotions, discounts or surcharges applicable at the time of contracting.

6.2. Payment methods

The Client may choose, according to the methods offered at any given time, between:

  • A single payment of the program amount.
  • Payment in installments in 12 monthly installments of €200 (resulting from dividing the base price of €2,400 by 12), it being understood that the final amount may vary as indicated in clause 6.1.
  • Financing through entities such as Klarna or seQura.
  • A non-cancellable monthly installment plan, formalized and signed by means of a contract, in which case the Client undertakes to pay all of the agreed installments.

6.3. Financing costs and price variations

The Client acknowledges and accepts that:

  • Taking out financing through external entities (for example, Klarna or seQura) may entail additional costs for the Client, set by such entities, for which TRADING.NET assumes no responsibility.
  • Both single payment and installment or self-financing methods may be subject to surcharges or discounts, in accordance with the commercial offer in force at any given time.

6.4. Non-payment

Failure to pay any of the installments may result in the suspension of access to the Service, without prejudice to the Owner's right to claim the amounts due pursuant to clause 13.

7. Access to the service and customer support

Once the contracting has been formalized and the payment (or financing) confirmed, the Owner will provide the Client with access to the Digital Training Materials.

Customer support is available on business days, Monday to Friday, from 10:00 to 18:30 (CET), through the channels provided and, where applicable, through the assigned tutor.

8. Right of withdrawal (EEA and UK consumers)

Where the Client acts as a consumer, they will have a period of 14 calendar days to withdraw from the contract, without needing to give any reason, in accordance with the consumer protection legislation applicable in their country of habitual residence.

This right derives from Directive 2011/83/EU and the corresponding national implementing rules, which include, by way of reference, the Italian Consumer Code (Legislative Decree 206/2005) and the equivalent rules of the other States of the European Economic Area. For consumers in the United Kingdom, the Consumer Contracts Regulations 2013 apply.

8.1. Loss of the right of withdrawal for digital content

The Service consists, in whole or in part, of the supply of digital content not supplied on a tangible medium. Consequently, and in accordance with the aforementioned legislation, the Client loses the right of withdrawal once performance of the supply has begun, provided that the Client:

  1. Has given their prior express consent for performance to begin during the withdrawal period, and
  2. Has expressly acknowledged that, with such commencement, they lose their right of withdrawal.

Therefore, if the Client accesses the Digital Training Materials within the 14-day period, performance will be deemed to have begun and the right of withdrawal will not apply. If the Client has not accessed the content, they may exercise the right of withdrawal within the stated period.

8.2. Spot reservation

Any amounts paid by way of spot reservation will not be refundable, as they correspond to a service already provided consisting of managing and blocking availability.

8.3. Exercising the right of withdrawal

To exercise the right of withdrawal, the Client must communicate it by means of an unequivocal statement addressed to privacy@trading.net, and may use the model form set out in Annex I. The Owner will acknowledge receipt and, where applicable, will refund the corresponding amounts using the same means of payment used, unless otherwise indicated by the Client.

9. Cancellation of the service

The Client may request cancellation through the messaging channels enabled with their tutor or by means of the form available on the Website. Cancellation does not extinguish outstanding payment obligations arising from the contracted payment or financing plans.

10. Client obligations

The Client undertakes to:

  • Use the Service and the Digital Training Materials in a personal, lawful manner and in accordance with these Conditions.
  • Not reproduce, copy, distribute, publicly communicate, resell or share the Digital Training Materials with third parties, in whole or in part.
  • Not share their access credentials.
  • Provide truthful information and keep it up to date.

Failure to comply with these obligations may result in the suspension or cancellation of access, without any right to a refund, and in a claim for compensation for the damage caused.

11. Intellectual property

All Digital Training Materials and other contents of the Service are owned by the Owner or by third parties who have authorized their use, and are protected by intellectual and industrial property legislation. Contracting the Service grants the Client a personal, non-transferable and non-exclusive license of use, limited to their own training purposes, without this implying the assignment of any exploitation rights.

12. Risk warning and disclaimer of liability

The Client acknowledges that they have read and accepted the Training Service Notice. In particular, they accept that:

  • Trading in the financial markets involves a high level of risk, including the possibility of losing the invested capital.
  • The Owner does not guarantee results or returns and does not provide financial advice.
  • Investment decisions are the sole responsibility of the Client.

To the maximum extent permitted by applicable law, the Owner shall not be liable for economic losses arising from the investment decisions taken by the Client. Nothing in these Conditions limits the Owner's liability in cases where such limitation is prohibited by mandatory consumer protection rules.

13. Debt collection and credit information

In the event of non-payment of the amounts due, the Owner may pursue their collection through the legally available channels, including, where applicable, management through third parties.

The Owner may also communicate the data relating to the debt to legally established credit information and solvency systems, where the requirements set out in the applicable legislation are met and after informing the Client as required by law. Once the debt has been settled, the Client may request the deletion of such data in accordance with the legislation in force.

14. Geographic restrictions

The Owner reserves the right not to provide the Service to persons residing in territories subject to international sanctions or whose legislation prohibits the activity offered, including, among others, Iraq and North Korea.

15. Changes to the Conditions

The Owner may amend these Conditions for legal, technical or commercial reasons. The amendments will be published on the Website and will apply to contracts entered into after their publication, in any event respecting the rights acquired by Clients.

16. Applicable law and dispute resolution

These Conditions are governed by the laws of the State of Florida (United States), without prejudice to the mandatory consumer protection rules applicable to the Client under the legislation of their country of habitual residence within the European Economic Area or the United Kingdom.

Where the Client acts as a consumer, nothing in these Conditions shall deprive them of the protection afforded by such mandatory rules, and they may bring any dispute before the courts of their place of habitual residence.

Consumers residing in the European Union also have access to the European Commission's online dispute resolution platform, available at https://ec.europa.eu/consumers/odr.
