Privacy Policy

1. Data controller

The controller of the personal data collected through the website https://trading.net (hereinafter, "the Website") is:

Hereinafter, "TRADING.NET" or "the Data Controller".

2. Applicable legislation

As the Data Controller's services are aimed at users located in the European Union, the European Economic Area and the United Kingdom, the processing of personal data is governed, where applicable, by:

  • Regulation (EU) 2016/679 of 27 April 2016 (GDPR), pursuant to its Article 3.2, as well as the national implementing legislation of the user's country of residence (among others, in Italy, Legislative Decree 196/2003, the "Personal Data Protection Code", as amended by Legislative Decree 101/2018; and the equivalent rules in France, Germany, Spain and the other EEA States).
  • For United Kingdom users, the UK GDPR and the Data Protection Act 2018.

The Data Controller processes personal data in accordance with the principles of lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, storage limitation, integrity and confidentiality.

3. Data we process

Depending on the relationship the user has with the Data Controller, we may process the following categories of data:

  • Identification and contact data: first name, surname, email, telephone number.
  • Access and registration data: credentials, account identifiers and, where applicable, data from social network login (for example Instagram, LinkedIn or X/Twitter), limited to the information authorized by the user.
  • Billing and payment data: data necessary for managing collection and invoicing. Card or financing details are processed directly by the corresponding payment or finance entities.
  • Usage and browsing data: IP address, device identifiers, cookies and similar technologies (see the Cookie Policy).
  • Data arising from the training relationship: progress, participation, support communications and requests.

The user guarantees the truthfulness and accuracy of the data provided and undertakes to keep it up to date.

5. Retention periods

Personal data will be kept for the time necessary to fulfill the purpose for which it was collected and, thereafter, for the periods legally required to address any liabilities arising from the processing (for example, accounting, tax or evidentiary obligations). Once these periods have elapsed, the data will be deleted or anonymized.

6. Recipients and data processors

Data may be disclosed to:

  • Service providers acting as data processors (hosting, technology platforms, analytics and marketing tools, customer support), who process the data following the Data Controller's instructions and with the contractual safeguards required by Art. 28 GDPR.
  • Payment and finance entities (for example, Klarna and seQura), for the management of collection and, where applicable, installment plans.
  • Public administrations and competent authorities, where a legal obligation exists.

Data is not transferred to third parties for purposes other than those indicated, except where legally required or with the user's consent.

7. International data transfers

As the Data Controller is established in the United States, and as certain providers may be located outside the European Economic Area, the processing of data may involve international transfers.

Such transfers are carried out applying the appropriate safeguards provided for in Chapter V of the GDPR, such as the standard contractual clauses approved by the European Commission, recognized certification mechanisms or, where applicable, adequacy decisions. The user may request information about the safeguards applied by writing to privacy@trading.net.

8. User rights

The user may exercise, free of charge, the following rights:

  • Access to their personal data.
  • Rectification of inaccurate data.
  • Erasure ("right to be forgotten").
  • Restriction of processing.
  • Portability of data.
  • Objection to processing.
  • Withdrawal of consent at any time, without affecting the lawfulness of prior processing.

To exercise these rights, the user may write to privacy@trading.net, indicating the right they wish to exercise and attaching, where necessary, a document proving their identity.

The user also has the right to lodge a complaint with the competent supervisory authority of their country of residence, in particular:

  • In Italy, the Garante per la protezione dei dati personali (www.garanteprivacy.it).
  • In the other EEA States, the corresponding national supervisory authority (for example, the CNIL in France).
  • In the United Kingdom, the Information Commissioner's Office (ICO).

9. Automated decision-making

The Data Controller does not make decisions based solely on the automated processing of data that produce legal effects concerning the user or similarly significantly affect them. Should this change, the user would be informed in advance and, where applicable, the safeguards and consents required by the legislation would be obtained.

10. Minors

The Website's services are aimed exclusively at persons of legal age. The Data Controller does not knowingly collect data from minors. If it is found that data of a minor has been provided without the legally required authorization, such data will be deleted.

11. Security

The Data Controller has adopted appropriate technical and organizational measures to ensure a level of security appropriate to the risk, in order to protect personal data against unauthorized destruction, loss, alteration, disclosure or access, in accordance with Art. 32 GDPR.

12. Changes to the Privacy Policy

The Data Controller reserves the right to amend this Privacy Policy to adapt it to legislative or case-law developments or to changes in business practice. Amendments will be published on the Website, indicating the date of the last update.
